West Des Moines Concrete & Masonry provides masonry and concrete services in the greater Des Moines, IA area, including but not limited to foundation repair, chimney repair, tuckpointing, brick repair, driveway pavers, retaining walls, stone masonry, and related work.
All work is subject to a written scope of work agreed upon by both parties before work begins. We do not guarantee specific timelines unless stated in a written agreement. Service availability is subject to scheduling, weather conditions, and permit lead times.
Estimates provided by West Des Moines Concrete & Masonry are based on information available at the time of the site visit. Written estimates are valid for 30 days from the date issued unless otherwise stated.
If conditions discovered during the work differ materially from what was visible at the time of the estimate - such as hidden damage, unexpected substrate conditions, or code requirements not previously known - we will notify you promptly and provide a written change order before proceeding with additional work. No additional charges will be applied without your written approval.
Verbal estimates provided by phone or email before a site visit are informational only and are not binding quotes.
We will confirm your scheduled start date in writing or by phone. We reserve the right to reschedule work due to weather conditions that would affect the quality or safety of the job, such as temperatures below the manufacturer's minimum for materials being used.
If you need to cancel or reschedule a confirmed appointment, please notify us at least 48 hours in advance. Cancellations with less than 48 hours notice on jobs where materials have already been ordered or delivered may result in a restocking or material charge.
We reserve the right to decline or discontinue work on any project at our discretion, including if site conditions are deemed unsafe, or if payment has not been received as agreed.
Payment terms are set out in the written estimate or contract for each project. Typical terms require a deposit at the time of signing, with the remaining balance due upon completion. Specific payment schedules for larger projects will be outlined in the project agreement.
Accepted payment methods will be communicated before work begins. Payment is due as specified in your project agreement. Invoices not paid within the agreed timeframe may be subject to a late fee of 1.5% per month on the outstanding balance, or the maximum rate permitted by Iowa law, whichever is lower.
Any amounts outstanding more than 60 days past the due date may be referred to a collections agency or pursued through legal channels. You agree to pay all reasonable costs of collection, including attorney fees, if applicable.
Where required by local building codes, West Des Moines Concrete & Masonry will obtain the necessary building permits before structural work begins. Permit fees, where applicable, will be included in the project estimate.
You agree to provide reasonable access to the property for city inspectors when inspections are required as part of the permit process. Delays caused by inspection scheduling are outside our control and do not constitute a breach of our agreement.

West Des Moines Concrete & Masonry warrants that all work will be performed in a workmanlike manner in accordance with industry standards. The specific warranty period for labor and materials will be stated in your written project agreement.
Warranty coverage does not extend to damage caused by events outside our control, including acts of nature, extreme weather events, flooding, soil movement unrelated to our work, or damage caused by subsequent work performed by others. Warranty claims must be reported to us in writing within the warranty period.
Except for the express warranty described in Section 8 and any warranty required by Iowa law, all services are provided "as is." We make no other warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose. Some Iowa consumer protection laws may provide rights that cannot be waived - nothing in these terms limits rights you have under applicable law.
To the maximum extent permitted by Iowa law, West Des Moines Concrete & Masonry is not liable for any indirect, incidental, consequential, or punitive damages arising from our services or your use of our website, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or related to services we performed is limited to the amount you paid us for the specific work that gave rise to the claim.

You and West Des Moines Concrete & Masonry each waive the right to a jury trial and to participate in any class action proceeding.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Iowa, without regard to conflict of law principles. Any legal action not subject to arbitration under Section 12 will be brought exclusively in the courts of Iowa.
We may update these Terms and Conditions at any time. When we do, we will revise the Effective Date at the top of this page. We encourage you to review this page periodically. Your continued use of our website or services after changes are posted means you accept the revised terms.
